These Terms of Service (“Terms”) govern your access to and use of Marching Band Movement, including our mobile applications, websites, and related services (collectively, the “Service”), operated by Marching Band Movement LLC (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

• You must provide accurate and complete information when creating an account.

• You are responsible for maintaining the confidentiality of your login credentials.

• You are responsible for all activity that occurs under your account.

• There are no age restrictions, but you must be legally capable of entering into a binding agreement in your jurisdiction.  The Marching Band Movement app is designed for informational and instructional purposes only.  Any other use of the app may result in termination of your account and legal prosecution.

2. Subscriptions and Payments

• The Service is offered either:

  • as a paid annual subscription, or

  • free with a valid paid coupon, expiring annually, if applicable.

• Payments are processed through third-party payment processors. We do not store your full payment card details.

• Subscription fees are billed in advance and are non-refundable, except where required by law.  Refund will be considered within 30 days if specifically requested.  You may email [email protected] to request a refund.

• We reserve the right to change pricing with reasonable notice.

3. Use of the Service

You agree not to:

• Use the Service for any unlawful purpose

• Attempt to access accounts or systems you are not authorized to use

• Interfere with or disrupt the Service or its security

• Reverse engineer, copy, or resell the Service unless expressly permitted

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

• The Service, including all software, design, text, graphics, and trademarks, is owned by Marching Band Movement LLC or its licensors.

• You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

• Nothing in these Terms transfers ownership of any intellectual property to you.

5. Third-Party Services

The Service may rely on third-party services (such as hosting, analytics, authentication, and payment providers).
We are not responsible for the content, policies, or practices of third-party services.

6. Availability and Modifications

• We do not guarantee uninterrupted or error-free operation of the Service.

• We may update, modify, or discontinue parts of the Service at any time.

• We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

7. Termination

• You may stop using the Service at any time.

• We may suspend or terminate your account if you violate these Terms or misuse the Service.

• Upon termination, your right to use the Service will immediately cease.

8. Disclaimers

The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Marching Band Movement LLC shall not be liable for indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.

10. Governing Law

These Terms are governed by the laws of the United States of America, Texas, without regard to conflict-of-law principles.
